DIGITAL GIFT CARD OVERVIEW

  

Digital Gift Cards may be redeemed to purchase products from the Site up to the nominated value of the gift card by entering the 16-digit Digital Gift Card ID number at checkout.

 

Digital Gift Cards are valid in the United States and available in U.S. Dollars only. Digital Gift Cards have no expiration date and no dormancy or service fees. The value on the Digital Gift Card is redeemable in whole for one transaction or in part for multiple transactions, at any time. There is no limit to the number of Digital Gift Cards that may be applied to an order. If a purchase exceeds the amount of the Digital Gift Card(s) used, the balance must be paid with a credit card or other available payment method. 

 

ALL PURCHASES OF DIGITAL GIFT CARDS ARE NON-REFUNDABLE AND NON-CANCELLABLE.

 

DIGITAL GIFT CARD DETAILS

 

Digital Gift Cards have no monetary value other than in connection with the purchase of services or products on the Site. You can check the balance of your Digital Gift Card by: (1) clicking the "VIEW GIFT CARD" button on the Digital Gift Card email sent at time of purchase, (2) within your Apple Wallet if you added the Digital Gift Card to your Apple Wallet at any time, or (3) contacting our Client Care Team at care@moodeaux.com. Original purchasers who have an active MOODEAUX® account can view their purchase history, including the purchase of Digital Gift Cards, but the corresponding 16-digit Digital Gift Card number and associated balances are not stored within that account.

 

Digital Gift Cards may be purchased online in any of the denominations made available on the Site. Promotional offers, coupons and discounts may not be used toward the purchase of Digital Gift Cards, and purchases of Digital Gift Cards cannot be used to satisfy free shipping, discount or promotional thresholds. Digital Gift Cards may be used for the initial purchase of subscription-eligible products, but not for the cost of future recurring orders. 

 

We know you care about your gift recipients. To protect their privacy, we will not collect personally identifiable information about gift recipients. Rather, we will send Digital Gift Cards only to your email address, so that you may forward your Digital Gift Card to them directly.

 

Title and risk of loss for each Digital Gift Card pass to the purchaser immediately upon purchase. We are not responsible if the Digital Gift Card information is lost, stolen, or used without the applicable recipient's permission. If Digital Gift Card information is lost or stolen, we may (in our sole discretion) issue a replacement for the balance shown in our records and may require certain verification information from the person requesting the replacement. We reserve the right, in addition to any other available remedies, to close a user’s account or require alternative forms of payment if a fraudulently obtained Digital Gift Card is redeemed or sought to be redeemed by that user.

 

DIGITAL GIFT CARD RESTRICTIONS

 

Digital Gift Cards cannot be: (1) redeemed for cash or credit, unless required by law; (2) reloaded; (3) transferred to another Digital Gift Card; or (4) resold. Attempted resale is grounds for seizure and cancellation without compensation. Digital Gift Cards obtained through unauthorized channels will be considered void.

 

Digital Gift Cards may be used as personal or business gifts, but may not be used in connection with any marketing, advertising, or other promotional activities (including, without limitation, via websites, Internet advertisements, email marketing, telemarketing, direct mail marketing, newspaper and magazine advertisements or radio, Internet and/or television broadcasts) unless you obtain our prior written approval in each instance.

 

DIGITAL GIFT CARD LIABILITY

 

MOODEAUX® MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO DIGITAL GIFT CARDS INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

 

IF A DIGITAL GIFT CARD IS NONFUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE TO REPLACE THE DIGITAL GIFT CARD WITH AN AMOUNT EQUAL TO THE AMOUNT REMAINING ON THE DIGITAL GIFT CARD.

 

CERTAIN STATE/PROVINCIAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY BE INAPPLICABLE AND ADDITIONAL RIGHTS MAY APPLY.

 

CHANGES TO THIS DIGITAL GIFT CARD POLICY

 

MOODEAUX® reserves the right to amend the terms and conditions of the Digital Gift Card at any time and to take appropriate action, including the cancellation of the card if, at its discretion, it deems such action necessary. Your purchase or use of a MOODEAUX® Digital Gift Card constitutes acceptance of the preceding terms and conditions.
